Se declaró la nulidad de todo lo actuado en la tutela promovida por la ciudadana de la referencia contra el Alcalde Municipal de San Juan del Cesar (Guajira), a partir del auto proferido por el Juzgado que conoció en principio de la tutela, lo anterior, porque dicho despacho judicial aplicó el Art. 1 del Decreto 1382 de 2000 que en reiteradas ocasiones esta Corte ha advertido que la norma es contraria a la Carta Política.
En consecuencia, se ordenó remitir el expediente al Juzgado respectivo para que realice el trámite que corresponda conforme a la Ley.

- Primero. DECLARAR la nulidad de todo lo actuado en la accion de tutela promovida por la senora Flor Maria Genis, contra el Alcalde Municipal de San Juan del Cesar (Guajira), a partir del auto del 24 de agosto de 2000 proferido por el Juzgado Unico Laboral del Circuito de San Juan del Cesar.
- Segundo. REMITASE el expediente al Juzgado Unico Laboral del Circuito de San Juan del Cesar, para que, de forma inmediata se le imprima a esta accion de tutela el tramite que corresponda conforme a la Ley.
